Conservation Easement Grants
Christopher H. Marine, Sandra G. Rennick
In recent years, the use of Conservation Easement grants between private land owners and governmental agencies has significantly increased. These include both traditional regulatory conservation easement grants related to real property development, and also negotiated conservation easement grants which involve the sale and transfer of certain ownership rights combined with retained owner use and possession. Real Property Group ("RPG") attorneys represent the legal interests of clients throughout the conservation easement transaction, assisting with all critical elements such as valuation considerations, defining permitted uses and rights, clarifying future governmental expectations relative to monitoring and restricted activities, and handling closings of easement grant transactions.
